Miami-Dade prosecutors have waived the death penalty against the four suspects accused of murdering former Washington Redskins star Sean Taylor.

Eric Rivera, 18, Venjah Hunte, 20 and Charles Wardlow, 18, all of Fort Myers, and Jason Mitchell, 20, of Lehigh Acres, face charges of first-degree murder and armed burglary.

They will still face the possibility of life in prison, but Assistant State Attorney Reid Rubin sent notice to the defendants’ attorneys late Friday he won't be seeking to kill them for their alleged crimes, said Hunte’s attorney, Michael Hornung.

"They would have had to show it was premeditated," Hornung said. "I believe that it's appropriate that they waive the death penalty."

Making it difficult for prosecutors to seek death is the theory Rivera, who was 17 at the time of the crime, was the alleged shooter. Because he was a minor at the time of the crime, case law has established the state wouldn’t be able to execute his adult co-defendants, Hornung said.

On Nov. 26, Miami-Dade police said, the four drove to Taylor’s house. When they arrived, they broke into the Redskins safety’s house intending to burglarize it. But Taylor, 24, was at home with his wife and child, recovering from a sprained right knee.

The Pro Bowl safety was shot in the leg and died of blood loss the next day.

According to Rivera’s statement to investigators, five people drove to the house that night in a rented SUV, but only four arrests have been made.

Taylor family spokesman Richard Sharpstein said he expected the age of Rivera, who was implicated as the shooter in a grand jury indictment, would derail the chance for prosecutors to seek death.

“The fact that the prosecution won’t seek the death penalty has been a foregone conclusion,” Sharpstein said. “The family is still supporting the prosecutors and looking for justice to be done.”

In the months since the shooting, prosecutors have been releasing reports and information related to the case. According to the indictment, Mitchell was in Taylor’s house wearing a mask during the armed burglary. Other reports released to the public have indicated the suspects used a 9 mm gun to shoot open a sliding glass door at the house. Dive teams searched off Alligator Alley after the shooting, but haven’t found a weapon.

According to information previously released by police, Mitchell attended a birthday party in September at Taylor’s home. He stayed at the house for several days, doing work around the house to prepare for the party and was paid $300 in cash. Mitchell said he saw Taylor give his sister, Sasha Johnson, $10,000 in a paper bag as a present. Johnson was dating Wardlow’s nephew at the time.

Investigators believe greed was the motive for the defendants making the three-hour drive to Florida’s east coast.

All four defendants have an Aug. 25 trial date.

The shooter is lucky that he was under 17, because he would get the Death Penalty. That being said I hope that they all get life in prison without parole! That's no parole, not 10 years good behavior back on the street crap!
Sean is gone and nothing will bring him back. But knowing that the murders are behind bars for the rest of their lives is something.

Yeah it's official now but I thought from the beginning it wouldn't be the eath penalty because it would be real hard to prove premeditation in this particular case.

I didn't think that they would get the death penalty either BigMike.

 I don't think that neither will get life imprisonment either. The shooter's age is going to help him out a lot and I think that the defense is going to argue that their main motive was robbery.

If the shooter does get paroled it better be after most people have forgotten or his life won't be worth spit.  Who would give him a job?  A car loan?  I would'nt even give him a place to live.

Well in my mind, premeditation can be proven. If he had no intent on shooting anyone why did he have a gun? If they just wanted to break in and steal, a crowbar would have been sufficient. I think he pulled the trigger with no regret and even in his araignment he showed no remorse...just tried to be a hard 'GANGSTA" ...but he is just really a punk who Sean would have beat the HELL out of man to man!

I didn't think they would get the death penalty..and even if they did..what would it do?  It won't bring Sean back..so what's the point?  Carrying a deadly weapon to a crime doesn't imply that they premeditated murder...they probably carried it "just in case"..as a scare tactic if you will...brandish the weapon and whoever might walk in will be too scared to try and stop them..I believe they panicked when they realized he was home...and I truly believe that they didn't know shooting him in the leg would lead to his death.  Most ppl don't know that a main artery runs through the groin and can cause ppl to bleed to death.  I'm not trying to make excuses for them....but you have to see things w/o all the emotion.  Do they deserve jail..absolutely...life in jail..but there's no guarantee of that either.  Don't be surprised if they don't plead this out and save the state of FL some cash and publicity.

I know alot of you are probably thinking...how can she have this kind of view about such a thing after what she's been thru...let me tell  you...it's b/c of my experience that I say these things.  They caught the 3 young men who were involved in my son's death...the 3 of them are in jail as I type this...and jail time whether it be 1 year or 100 years..it does NOTHING to change my circumstance.  My son is still gone...and so is the Taylor's.  It doesn't matter how much time they get...it won't change a thing for them.  The young men involved in my son's murder were all under the age of 22...they got 15y, 15y and 69y respectively.  The one who got 69y wasn't even the shooter!  He was suckered into a plea bargain w/the threat of life in prison..the DA knew he couldn't get a life sentence in that case..it was only 2nd degree murder...which in VA carries a maximum of 40 years..but that dude didn't know they would be charged w/2nd degree..they told him they were charging them w/1st degree..so he took the deal..the other 2 went to trial and a jury gave the actual shooter 15 years and another jury gave the driver 35y then the judge suspended 20 b/c he couldn't "in good conscious give the driver more time than the shooter  Roll Eyes  The justice system in this country is in serious need of a revamp..criminals have more rights than victims will ever have...those 3 "boys" still have their lives...I visit my son in a cemetary...I can never get him back...The Taylors will go thru the same thing...if the dudes get life w/o parole..it doesn't give them any "closure"...it doesn't bring Sean back...and it doesn't serve Justice in the true sense of the word..the only ppl who got a life sentence in this case are the Taylors!  Believe me...I'm living it ...Justice my eye..there's no such thing after someone kills your child!..

Sorry I rambled...but death penalty or not...The Taylors still lost a son that day..something that no amount of punishment can ever change!

RIP ST!  God be w/your family.  God will be the only justice that we will ever get...and even then..if these folks repent and ask for forgiveness...God will give them that too.

Honestly, i think they should get it, because they took someones life with the intent. If that had not been the case he/they would have never had a gun on them. It's BS that they/he just meant to shoot him in the leg. They kept trying to force their way in through the bedroom door, even though they knew someone was in there. It was a forced entry with a gun, and they intended to shoot!

D-247, you make an excellent point about the guys trying to force their way into the room after they knew the family was there and you are right that may weigh heavy in the trial because they had a chance to run. But as far as bringing the gun to the robbery, I do not think that most robbers are going to break into a house without having a gun.
